This Privacy Policy explains how Tharshana Designer Wear ("Tharshana", "we", "us") collects, uses and shares your personal information when you visit or buy from www.tharshana.com (the "Site"), contact us, or otherwise use our services. Tharshana operates from Sri Lanka and, for orders shipped within the United States, through Tharshana USA Inc. Contact details are at the end of this policy.
Information we collect
Information you give us
- Contact details: name, email address, phone number, and shipping and billing addresses.
- Order details: what you buy, order notes, discount codes, returns and refunds.
- Account details: if you create an account, your login email, saved addresses, wishlist and order history.
- Communications: messages you send us by email, chat, phone or social media, and reviews you submit.
- Marketing preferences: whether you've signed up for our emails, and through which form.
Payment information
Card and payment details are entered directly with our payment providers (listed below). We don't see or store your full card number.
Information collected automatically
When you use the Site, we and our service providers collect device and usage information such as your IP address, browser and device type, approximate location, pages viewed, products added to cart, how you arrived at the Site, and similar information. This is collected through cookies, pixels and similar technologies (see "Cookies and tracking" below).
How we use your information
- To process and deliver your orders: taking payment, arranging shipping, sending order and shipping updates, and handling returns, exchanges and refunds.
- To provide customer support and respond to your questions.
- To run your account, including your wishlist and order history.
- For marketing: sending emails about new prints, collections and offers if you've signed up (you can unsubscribe at any time using the link in any email), and showing you relevant ads on platforms such as Facebook and Instagram.
- To improve the Site and understand how customers use it.
- For security and fraud prevention, and to protect our customers and business.
- To meet legal obligations, such as tax, accounting and record-keeping requirements.
How we share your information
We don't sell your personal information for money. We share it only as needed with:
- Shopify, which hosts our store, checkout, customer accounts, email and chat. See Shopify's Privacy Policy.
- Payment providers: Shopify Payments and Shop Pay, PayPal (including Venmo), Google Pay, Apple Pay, Amazon Pay, and in Sri Lanka, PayHere, Koko and Mintpay. Each processes your payment under its own privacy policy.
- Shipping carriers such as UPS, USPS and our Sri Lankan delivery partners, who receive your name, address and phone number to deliver your order.
- Advertising and social media partners, including Meta (Facebook and Instagram), which receive information about your activity on the Site through the Meta Pixel and Conversions API so we can measure and improve our ads.
- Service providers who help us run the business, such as review (Judge.me), wishlist, email sign-up, accounting (QuickBooks) and inventory (ERPAG) tools.
- Authorities or others where required by law, to protect our rights, or as part of a business sale or reorganisation.
Cookies and tracking
We use cookies and similar technologies to keep your cart and session working, remember your preferences (such as your country and currency), understand how the Site is used, and measure and personalise advertising. You can control cookies through your browser settings and, where shown, our cookie banner. Blocking some cookies may affect how the Site works. You can also manage how Meta uses data from other websites through your Facebook or Instagram settings ("Your activity off Meta technologies").
How long we keep your information
We keep order information for as long as we need it to fulfil and support your order and to meet tax and accounting obligations (usually up to 7 years). We keep account and marketing information until you delete your account or unsubscribe, unless we need to keep it longer for legal reasons.
International transfers
We operate in Sri Lanka and the United States, and our service providers may process data in other countries, including the United States and the European Union. Where data is transferred internationally, we rely on our providers' safeguards, such as standard contractual clauses, to protect it.
Your rights
Depending on where you live, you may have the right to:
- access the personal information we hold about you and get a copy of it
- correct inaccurate information
- ask us to delete your information
- object to or restrict certain uses, including direct marketing
- withdraw consent where we rely on it
- opt out of "sharing" or "targeted advertising" (for residents of certain US states)
These rights apply under laws such as Sri Lanka's Personal Data Protection Act, the UK and EU GDPR, and US state privacy laws such as those in California and Connecticut. To make a request, email tharshana@tharshana.com. We'll need to verify your identity, and we won't treat you differently for exercising your rights. If you're in the UK or EU, you can also complain to your local data protection authority.
Security
We use reasonable measures to protect your information, and payments are encrypted and handled by our payment providers. No method of transmission or storage is completely secure, so we can't guarantee absolute security.
Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top shows when it was last changed.
